Terms and Conditions
Scope of Work
Earth to Sky LLC will perform tree and landscape health care services as outlined in this proposal. Services include plant health care applications, monitoring, and maintenance activities as specified.
Service Scheduling
Services are scheduled based on optimal biological timing, weather conditions, and site requirements. Exact service dates are approximate and subject to change.
Billing & Payment
Invoices are issued upon completion of services unless otherwise agreed. Payment is due within 7 days of invoice date. Late payments may incur a 1.5% monthly service charge.
Annual Program Agreement
Annual programs are designed as recurring service agreements to maintain consistent plant health outcomes. Program pricing reflects scheduled service intervals and monitoring.
Cancellation
Client may cancel services at any time with written notice. Services completed prior to cancellation will be invoiced.
Access & Site Conditions
Client agrees to provide safe and unobstructed access. Earth to Sky LLC is not responsible for damage to:
- unmarked utilities
- irrigation systems
- underground features not disclosed
Plant Health Care Applications
Services may include fertilizers, pesticides, growth regulators, or biological agents applied in accordance with all federal, state, and label requirements.
Performance Disclaimer
Due to environmental variability, plant health conditions, and biological response, Earth to Sky LLC does not guarantee specific results from treatments.
Pre-Existing Conditions
Earth to Sky LLC is not responsible for plant conditions existing prior to service, including:
- decline
- pest infestations
- structural defects
Tree Risk Disclaimer
Tree care reduces but does not eliminate risk. Earth to Sky LLC does not guarantee that trees will not fail or cause damage.
Limitation of Liability
Earth to Sky LLC’s liability is limited to the cost of services provided. Under no circumstances shall Earth to Sky LLC be liable for indirect or consequential damages.
Force Majeure
Earth to Sky LLC is not liable for delays or damages caused by weather, drought, pests, or other natural events beyond control.
Change of Scope
Additional work outside the defined scope will be quoted and approved prior to execution.
